Legislation in Linz in 2026
Unlike neighboring Germany which has legalized recreational use, Austria maintains a more conservative approach. Here is what you need to know if you live in or visit Linz.
CBD is King (Legal)
In Linz, CBD products with a THC level below 0.3% are completely legal. This includes flowers, oils, and cosmetics sold in the many CBD shops in the city (like CBD Flora or CBDNOL).
Partial Decriminalization
Recreational cannabis with THC is still illegal. However, possession of small amounts (generally less than 20g) for personal use has been decriminalized since 2016. A first offense often leads to a referral to health services ("Therapy instead of punishment") rather than a prison sentence.
Medical Cannabis
Austria has a medical program, but it is restrictive. Doctors can only prescribe cannabis-based medicines (like Sativex or Dronabinol). Raw cannabis flower cannot be prescribed, unlike in Germany.
⚠️ Border Warning: Following the legalization in Germany in April 2024, the Austrian police have intensified border controls. Never bring cannabis from Munich or Passau to Linz, it is considered international trafficking.
